These Terms of Service ("Terms") govern your use of the SpendTrak mobile application and related services (the "Service") operated by SpendTrak ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using SpendTrak, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

You must be at least 13 years old to use the Service. By using SpendTrak, you represent that you meet this age requirement.

2. Description of Service

SpendTrak is a personal finance management application that provides:

• AI-powered receipt scanning, categorization, and analysis of spending
• Budget tracking, goal setting, and financial insights
• Subscription monitoring and alerts
• Multi-currency support and conversion
• AI financial consultant (Premium tier)

Features may vary based on your subscription tier and may be modified, added, or removed at our discretion.

3. User Accounts and Responsibilities

You are responsible for:

• Providing accurate and complete information during registration.
• Maintaining the security of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use of your account.

You agree not to:

• Share your account with others or create multiple accounts.
• Use the Service for any illegal or unauthorized purpose.
• Attempt to access other users' data or interfere with the Service's infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated tools to scrape or extract data from the Service.

4. Subscription and Billing

4.1 Subscription Plans

SpendTrak offers Free, Pro, and Premium subscription tiers. Paid subscriptions are billed monthly through the Apple App Store or Google Play Store.

4.2 Free Trial

New users may be eligible for a free trial of paid features. At the end of the trial period, your subscription will automatically convert to a paid subscription unless cancelled.

4.3 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period. You will be charged the applicable subscription fee unless you cancel before the renewal date.

4.4 Cancellation

You may cancel your subscription at any time through the Apple App Store or Google Play Store settings. Cancellation takes effect at the end of the current billing period. No refunds will be issued for partial periods.

4.5 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price increase. Continued use after a price change constitutes acceptance of the new price.

5. Intellectual Property

The Service, including all content, features, functionality, design, code, trademarks, and logos, is owned by SpendTrak and protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of your financial data. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.

6. Disclaimer — Not Financial Advice

SpendTrak is a financial tracking and organizational tool. It does not provide financial advice, investment recommendations, tax advice, or any other form of professional financial guidance.

The AI-generated insights, categorizations, and suggestions provided by SpendTrak are for informational purposes only. You should consult qualified financial professionals before making financial decisions.

We do not guarantee the accuracy, completeness, or reliability of AI-generated content, transaction categorizations, or spending analyses.

7. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
• We are not responsible for any financial decisions made based on information provided by the Service.

8. Indemnification

You agree to indemnify and hold harmless SpendTrak, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

9. Termination

We may suspend or terminate your account at our discretion if:

• You violate these Terms.
• Your use of the Service poses a security risk.
• We are required to do so by law.
• We discontinue the Service or any part of it.

You may terminate your account at any time by deleting your account through the app settings or contacting us at [email protected]. Upon termination, your data will be handled as described in our Privacy Policy.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates (UAE). Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the UAE.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

If you disagree with updated Terms, your sole remedy is to stop using the Service and delete your account.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SpendTrak regarding the Service, and supersede all prior agreements and understandings.
